Commitment description
What is the commitment? To increase the accessibility of persons with disabilities and of African
descent to calls for application for positions in the public sector. To increase
governance by promoting the monitoring of civil society's compliance with the
regulations for the protection of persons with disabilities and of African
descent.
The calls for persons with disabilities and of African descent can be viewed
on the Uruguay Concursa Portal independently of all other calls. It will also
be possible to access open data on compliance with the hiring quotas for
persons with disabilities and of African descent in public bodies.
What is the problem that
the commitment will
address?
Persons of African descent and with disabilities are not able to independently
visualize the calls addressed to these populations. This, in turn, makes it
difficult for civil society to monitor the effective compliance of both calls and
hiring. The proposed commitment will assist the policy monitoring by civil
society and promote improved accountability.
How will the commitment
contribute to solving the
problem?
The calls that include a quota for persons with disabilities and of African
descent will be separately and more easily viewed in the Uruguay Concursa
Portal.
Data on annual compliance with legal provisions of affirmative action by
public bodies will be published in the open data portal.

It contributes to the Transparency and Accountability of Law 18 651 articles
49 and 50, Decree 79/014 and Law 19 122 article 4, Decree 144/014, Civil
Society organizations will have elements to monitor, as well as those directly
involved.
Additional information
This commitment works towards SDG 16: Promote peaceful and inclusive societies for
sustainable development, provide access to justice for all and build effective, accountable and
inclusive institutions at all levels. And specifically to Target 16.7: Ensure responsive, inclusive,
participatory and representative decision-making at all levels.
The current regulations governing this commitment are Law 18 651 articles 49 and 50, Decree
No. 79/014 and Law 19 122 article 4, Decree No. 144/014.

26. Uruguay Concursa: llamados para personas con discapacidad y afrodescendientes
Texto del compromiso como aparece en el plan de acción:
Incrementar la accesibilidad de las personas con discapacidad y las personas afrodescendientes a los llamados a puestos de trabajo públicos. Incrementar la gobernanza promoviendo el seguimiento del cumplimiento de la normativa de protección de personas con discapacidad y afrodescendientes por parte de la sociedad civil.
Se podrá visualizar en el Portal Uruguay Concursa los llamados para personas con discapacidad y afrodescendientes de forma independiente de la totalidad de los llamados. Se podrá a su vez acceder a datos abiertos sobre el cumplimiento de las cuotas de ingreso para personas con discapacidad y afrodescendientes en los organismos públicos.
Los hitos de este compromiso son:
- Publicar en el Catálogo de datos abiertos, datos sobre el cumplimiento de cuotas de ingreso a organismo públicos en el año 2018 de las personas con discapacidad y afrodescendientes a los llamados a puestos de trabajo públicos.
- Incorporar un nuevo filtro de forma separada en los concursos dirigidos a personas con discapacidad y a personas afrodescendientes en el Portal Uruguay Concursa

Contexto y objetivos
A través de la Ley 18.651 de Protección Integral de las Personas con Discapacidad [109] y la Ley 19.122 Afrodescendientes: Normas para favorecer su participación en las áreas educativa y laboral [110], se establecieron cupos en la administración pública para las personas con discapacidad o personas afrodescendientes.
Desde 2014 la ONSC realiza informes anuales del cumplimiento del artículo 4to de la Ley 19.122, que se publican en la página web de la oficina, son enviados al Parlamento, se presentan en distintas jornadas y a la Comisión implementadora y su Consejo Consultivo. A su vez se publican y presentan al Parlamento los informes sobre el ingreso de personas con discapacidad (Art. 49-51 de la Ley 18.651) desde el año 2011.
El compromiso propuesto por la Oficina Nacional del Servicio Civil (ONSC) busca mejorar el acceso a la información y seguimiento del efectivo cumplimiento de la política, tanto en los llamados como en los ingresos, como facilitar la visualización en el portal Uruguay Concursa de los llamados que contemplan cuota para personas con discapacidad y afrodescendientes. Para cumplir con este objetivo, se propone publicar en formato abierto en el Portal Uruguay Concursa los datos sobre cumplimiento anual de las disposiciones legales de acciones afirmativas por parte de los organismos públicos y disponer de un filtro en el portal Uruguay Concursa que permita ver los llamados para personas con discapacidad y afrodescendientes de forma independiente de la totalidad de los llamados.
El compromiso es relevante al valor del acceso a la información ya que se pondrá a disposición información en formato abierto que se podrá reutilizar y facilitará el acceso a información que hasta ahora no estaba disponible. Los hitos del compromiso tienen suficiente claridad y especificidad para que su cumplimiento se pueda verificar objetivamente.
Las investigadoras del IRM consideran que la implementación del compromiso será un avance en la transparencia y acceso a la información. Asimismo consideran que tendrá un impacto menor en lo referido al seguimiento del cumplimiento de las políticas de inclusión laboral de las personas con discapacidad o afrodescendientes, en tanto el abrir la información es un paso adelante pero no es suficiente para generar un proceso de monitoreo por parte de la sociedad civil.
Una integrante del Consejo Consultivo de Sociedad Civil [111] de la Comisión Implementadora de la Ley N°19.122 manifestó a la investigadoras del IRM que las acciones previstas en este compromiso se consideran de relevancia y responden a demandas realizadas por las organizaciones de la comunidad afrodescendiente, aunque el Consejo Consultivo como tal no participó en la cocreación del compromiso [112]. Sobre este punto la representante afirmó: “Esto es una demanda de la sociedad civil, específicamente en el marco del trabajo afirmativo que es un tema de trabajo dentro de la Coordinadora: es algo que hemos solicitado varias veces a la ONSC y lo hemos propuesto en el marco del Consejo Consultivo”.
Se contactaron organizaciones que trabajan en el área de discapacidad, pero no se obtuvo respuesta antes del cierre de este informe [113].
Siguientes pasos
Tomando en cuenta la relevancia que este compromiso tiene para el cumplimiento de las cuotas de inclusión laboral de la población afrodescendiente y de las personas con discapacidad, se recomienda darle seguimiento en un próximo plan con acciones más ambiciosas. De cara a un nuevo compromiso se considera primordial que este sea cocreado con las organizaciones de la sociedad civil que trabajan por los derechos de las personas afrodescendientes y de las personas con discapacidad, para lograr así una definición más ajustada a las necesidades y con un impacto más transformador.
De acuerdo a lo que manifestara la persona referente de la sociedad civil [114], una de las posibles líneas a trabajar a futuro y que podría tener un impacto mayor, es el desarrollo de acciones que den garantías que la ley se aplique de igual forma por todos los organismos. Si bien existe un protocolo, actualmente se aplica de distinta manera por los diversos organismos, lo que no genera las garantías necesarias y da lugar a la discrecionalidad. De acuerdo a lo expresado por la persona referente, la cuota que instaura la ley tendría que estar presente en todos los llamados, pero depende de la interpretación de cada organismo: “No todos los llamados incorporan la cuota. Si en un primer llamado llegan al 8% en el resto de los llamados ya no lo hacen. Se toma el 8% como un techo y no como un piso”.
Para atender esta problemática, se propone que la ONSC centralice todos los llamados y funcione como veedora para garantizar el cumplimiento del protocolo de implementación de la ley de igual forma en todos los organismos.
En relación a la implementación del presente plan, se recomienda involucrar más efectivamente a las organizaciones de la sociedad civil en el desarrollo del compromiso, con el objetivo de poder atender algunos de los problemas detectados y orientar mejor los resultados.
