What is the public problem that the commitment will address?
Since the second half of 2016, a large number of alleged acts of corruption derived from the contracting and execution of public works took public status. There were judicial cases involving former public officials and businessmen in the field. In this context, the issue of transparency and anti-corruption came into the public agenda. Public works represent between thirteen percent (13%) and twenty percent (20%) of the Gross Domestic Product (GDP) according to estimates of the Organization for Economic Cooperation and Development (OECD). This huge volume of money indicates the impact that this item has on the general economy and the lives of Argentines; and constitutes a key element for the management of any government. The success or failure of a government is affected by its ability to perform public works that are necessary and of good quality, and that improve people's lives; but also by the ability to carry them out with efficiency and transparency. We refer to a scheme governed by Law 13,064 promulgated in 1947, which although it constitutes a very solid and comprehensive legal instrument has more than seven decades. Likewise, there was no governing body for this subject with the competence to regulate, standardize and interpret with uniform criteria the regulations and the various issues that occur throughout the different contracting and execution processes. This situation caused that each ministry or agency in charge of carrying out works could decide and interpret according to their particular criteria (as they could or would like); giving rise, on the one hand, to a favorable ground for corruption scenarios; and on the other, to a general system disorderly complex and very diverse. Based on this diagnosis and understanding the need to move forward with more tools, the signing of Decree 1169/2018 has as a fundamental consequence the establishment of the ONC as the governing body of the public works contracting and concession system. This body has the power to design, formulate, plan, organize, evaluate and control policies in order to strengthen the aforementioned system, mitigate the risk of mismanagement, cost overruns and corruption; as well as improve the accessibility, transparency and efficiency of the processes. We must emphasize that prior to this situation, the publication of contracts and execution of public works contracts was very limited and depended on each ministry.
What is the commitment?
The commitment is to publish information in open formats about the life cycle of public works contracts. Documentation supporting the hiring will also be published and a multi-stakeholder roundtable (government, civil society, private sector) will be formed in order to propose reforms to current regulations, improvements in the management of works and publication of new datasets, in the framework of the powers of the National Contracting Office (ONC).
It is expected to achieve a comprehensive improvement of the Public Works Contracting System, which favors its transparency, integrity and efficiency, and that values -and expands- the progress achieved through the implementation of the Open Contracting Data Standard, commitment developed by the ONC within the framework of the Third OGP National Action Plan.
How will the commitment contribute to solving the public problem?
The periodic publication of information on the life cycle of public works contracts will increase transparency in these processes and facilitate access to key information for the exercise of citizen control, reducing the risk of corruption. Likewise, the creation of a multi-stakeholder roundtable will promote dialogue with civil society and other actors to formulate proposals aimed at strengthening the management and system of public works contracts and concessions.
Why is this commitment relevant to OGP values?
The commitment is mainly relevant to transparency because it incorporates open data on the life cycle of public works and information on the supporting documentation of contracts on the Contrat.ar site. It also favors citizen participation with the creation of a multi-stakeholder roundtable that will address and propose lines of work within the framework of the ONC's powers.
Additional information
In the Third OGP National Action Plan (2017-2019) a commitment (No. 9) on access to information and transparency in public procurement of goods and services was included, the ONC being the governing body in the matter.
The commitment was aimed at advancing the implementation of the Open Contracting Data Standard (EDCA, for its acronym in Spanish) for purchases and contracting of goods and services processed through the Electronic Purchasing System (COMPR.AR), as well as promoting awareness of state and external actors on the potential of implementing the EDCA. As of December 2018, Decree 1169/2018 establishes the ONC as the governing body of the public works contracting and concession system. In this way, it becomes competent to assume commitments in that area.
