Description
Access to judicial processes Commitment start and end date: March 2019 to June 2020. Institution or actor responsible for the implementation: the Judicial Branch. New Commitment. Theme: Security-Justice-Anti-Corruption Commitment description What is the commitment? To enable citizens who are involved in judicial processes (in any capacity, such as complainant, plaintiff, defendant, legal representative or judicial operator) to access information on those processes, ensuring total transparency of the process. To implement the system that enables legal representatives of citizens (lawyers) to file demands directly and move towards the consultation of files through the Single Judicial Window so that all the information pertaining to the process can be viewed. How will the commitment contribute to solving the problem? This commitment aims to universalize access to information from judicial processes for citizens, through the use of information technologies. What is the problem that the commitment will address? At present, citizens do not have full access to information on court files, as the web consultation system does not incorporate much of the content recorded in the electronic file (for example audios of the AUDIRE system). The commitment addresses aspects of transparency and accessibility for citizens, in an area as important as access to justice. Currently, only judicial operators (judges, lawyers, attorneys, prosecutors, defenders, etc.) have access to this level of detail of the information in the process. OGP value to which this commitment will contribute. Access to all public information in electronic files will be available to citizens in general, bolstering transparency of the judicial system. Additional Information The implementation of this commitment will be the responsibility of technicians who make up the stable team of the Technology Division of the Judicial Branch, which will allow the effective implementation and sustainability of this project. 13. Acceso a los procesos judiciales
Texto del compromiso como aparece en el plan de acción:
Habilitar el acceso a toda la ciudadanía a los procesos judiciales en los que es parte (en cualquier calidad, tales como denunciante, denunciado, demandantes, demandado, representante legal u operador jurídico), garantizando la total transparencia del proceso. Implementar el sistema que habilite el ingreso de las demandas en forma directa por parte de los representantes legales de los ciudadanos (abogados), y evolucionar la consulta de expedientes a través de la Ventanilla Única Judicial para que los mismos puedan visualizar toda la información del proceso.
Los hitos de este compromiso son:

Contexto y objetivos
Hasta el momento de adopción de este compromiso, la ciudadanía no podía tener acceso completo a la información de los expedientes judiciales. Esto porque el sistema de consulta web no incorporaba todo el contenido que registra el expediente electrónico, como, por ejemplo, los audios de las audiencias grabados a través AUDIRE [52], un sistema de registro instaurado con la puesta en funcionamiento del nuevo Código del Proceso Penal (CPP) [53] en julio de 2017, a partir del cual las audiencias pasan a ser orales.
Hasta este momento, únicamente los operadores judiciales (jueces, abogados, procuradores, fiscales, defensores, etc.) tienen acceso a toda la información del proceso. Este compromiso tiene como objetivo facilitar el acceso a toda la información pública de los expedientes electrónicos a la ciudadanía en general, fortaleciendo la transparencia del sistema judicial.
Este compromiso da seguimiento a lo que inició el Poder Judicial en el tercer plan de acción con un compromiso sobre acceso a la información del Poder Judicial [54] que incluyó acciones de transparencia de información estadística y la implementación de un proceso para canalizar y responder la demanda de información de parte de la ciudadanía. La información estadística fue puesta a disposición en formato abierto, configurando una apertura significativa del Gobierno en términos de acceso a la información, pero no se avanzó en las acciones de participación ciudadana.
Como lo indican distintas fuentes [55] y hechos, como el bajo número de compromisos relativos a justicia abierta que incorporan los planes de gobierno abierto en el marco de OGP [56], la transparencia del sector judicial es uno de los grandes desafíos que enfrenta el gobierno abierto. Este compromiso, junto a otros dos (14 y 15) que el Poder Judicial incluye en la línea de justicia abierta de este plan, constituyen un nuevo avance, como lo confirman las fuentes de la sociedad civil consultadas por las investigadoras del IRM.
La persona referente de la organización Uruguay Transparente [57], recalcó que es destacable el compromiso del Poder Judicial con el gobierno abierto, participando en forma activa y efectiva. “El nuevo código penal ha implicado la apertura de muchas cosas y ha habido un cambio muy importante en término de transparencia”, manifestó a las investigadoras del IRM.
Por su parte, la persona referente de CAinfo [58], indicó que los compromisos del Poder Judicial en el plan pueden tener impacto transformador dado que: “el poder judicial es una organización muy conservadora, a la que le ha costado abrirse, si bien se realizaron avances en los últimos años”.
Las acciones propuestas en este compromiso son lo suficientemente específicas como para poder evaluar su cumplimiento en forma objetiva. De ser implementado completamente, las investigadoras del IRM consideran que el compromiso tendrá un impacto moderado ya que propone acciones claras y ajustadas para que todas las personas puedan conocer el estado de los asuntos judiciales de los que son parte, sin intermediación y en tiempo real, lo que garantiza su derecho a una justicia apegada al debido proceso.
Siguientes pasos
Este compromiso avanza en la apertura del Poder Judicial, implicando un paso muy importante en su transparencia que responde asimismo a demandas de larga data de la sociedad civil. Para potenciar aún más su alcance, las investigadoras del IRM, recomiendan el establecimiento de un sistema de consulta o retroalimentación con usuarios y potenciales usuarios, que permitan evaluar el funcionamiento del sistema creado, su utilización y el grado de adecuación a las necesidades, así como también la eventual necesidad de realizar ajustes al mismo.
