Commitment description
What is the commitment? To build a new system that enables the recording of hearings on video,
and access to them by the judicial operators and the parties involved in
the cases, through the Single Judicial Window.
This is a first phase that will enable, at a later stage, a feasibility
analysis of making video trial hearings available to all citizens.
What is the problem that the
commitment will address?
Although the new Code of Criminal Procedure guarantees public
access to hearings, today it is necessary for citizens to personally go to
the Centralized Criminal Office in the case of Montevideo to attend said
hearings, or to the Legal Court with corresponding criminal jurisdiction
in other parts of the country.
Currently, the Judicial Branch records hearings that are held within the
framework of the new Code of Criminal Procedure, using the AUDIRE
system, which records only audio.
How will the commitment
contribute to solving the problem?
The video recording of the hearings will enable unrestricted access to
all judicial operators and parties to the case, from any location, allowing
to observe the development of this highly relevant stage of the process
with full transparency.

The video recording of public hearings contributes to strengthening
transparency, this being the first step towards direct access by citizens
to be able to watch what happens in a criminal hearing without having
to go to the judicial headquarters in which it takes place.

Additional Information
The recording system to be developed will be implemented by technicians of the Judicial
Branch's own team, as an evolution of the AUDIRE system.
The specific aspects of storing and safeguarding a large volume of information must be
strongly analyzed, as well as the necessary infrastructure that will be required in the future to
provide access to these video contents from the Judicial Branch's website.

14. Audiencias Públicas en Video
Texto del compromiso como aparece en el plan de acción:
Construir un nuevo sistema que permita la grabación de audiencias en video, y el acceso a los mismos por parte de los operadores judiciales y las partes involucradas en los expedientes, a través del portal Ventanilla Única Judicial. Esta es una primera fase que habilitará en una instancia posterior en análisis de viabilidad de disponibilizar para toda la ciudadanía las audiencias de juicio en video.
Los hitos de este compromiso son:
- Construir el nuevo sistema que permita la grabación de audiencias en video.
- Implementar un proyecto piloto en la Oficina Penal Centralizada (OPEC) de Montevideo.
- Desarrollar y disponibilizar la funcionalidad que permita a los operadores judiciales y partes del expediente acceder a los videos de las audiencias.

Contexto y objetivos
El nuevo Código del Proceso Penal (CPP) [59], vigente desde el 1° de noviembre de 2017, instaura un sistema de audiencias orales y públicas. Para poder presenciar dichas audiencias, la ciudadanía interesada debe concurrir personalmente a la Oficina Penal Centralizada, en el caso de Montevideo, o al Juzgado Letrado con competencia penal que corresponda, en el interior del país. Si bien a partir de la implementación del nuevo sistema las audiencias se graban a través del sistema AUDIRE [60], este registro es solo del audio.
Este compromiso tiene como objetivo implementar un sistema para registrar en video las audiencias y ponerlas a disposición de los operadores jurídicos y partes involucradas en el expediente. Se lograría así acceder con total transparencia al desarrollo de la instancia central de un proceso penal. El compromiso implica el desarrollo de un proyecto piloto en la Oficina Penal Centralizado en Montevideo, lo que se vislumbra como el primer paso hacia el acceso directo por parte de la ciudadanía a las audiencias penales, sin necesidad de concurrir a la sede.
Como lo indican distintas fuentes [61] y hechos, como el bajo número de compromisos relativos a justicia abierta que incorporan los planes de gobierno abierto en el marco de OGP [62], la transparencia del sector judicial es uno de los grandes desafíos que enfrenta el gobierno abierto. Este compromiso, junto a otros dos (13 y 15) que el Poder Judicial incluye en la línea de justicia abierta de este plan, constituyen un nuevo avance, como lo confirman las fuentes de la sociedad civil.
La persona referente de CAinfo [63], organización experta en temas de acceso, manifestó que la implementación de un piloto de estas características es de gran impacto para ampliar el alcance de lo que establece el nuevo código penal.
Por su parte, el referente de El Paso [64], organización especializada en cuestiones de trata y tráfico de personas, coincidió que la posibilidad de acceder a la filmación en video de la audiencia es de suma relevancia ya que permite que se pueda analizar en otro momento. Sin embargo, manifestó que es necesario tener recaudos en ciertas situaciones de mucha sensibilidad, donde se deben hacer algunas excepciones a la apertura para cuidar a las víctimas. Existen algunos criterios establecidos por los cuales el juez puede decidir no habilitar el acceso del público a esas audiencias, pero ante esta situación las razones deben ser fundamentadas.
Las acciones propuestas en este compromiso son lo suficientemente específicas como para poder evaluar su cumplimiento en forma objetiva. De ser implementado completamente, las investigadoras del IRM evalúan que el compromiso tendrá un impacto moderado. La propuesta de este compromiso de contar con la grabación de video de las audiencias, que hasta ahora las partes interesadas solo podían tener acceso concurriendo directamente a las oficinas o a través de los registros de audio, es un gran avance. Sin embargo por ahora está limitado a un piloto en la oficina de Montevideo y con acceso restringido a los operadores judiciales y partes del caso. De ampliarse la cobertura a todo el país y estar disponible a toda la ciudadanía, su impacto sería transformador.
Siguientes pasos
Una vez implementadas las acciones propuestas en este compromiso, se recomienda realizar una evaluación sobre sus resultados entre los usuarios y potenciales usuarios y recoger la retroalimentación necesaria para determinar la viabilidad de ampliar su implementación en todo el país y que se accesible a todas las personas interesadas, más allá de los directamente afectados.
