What is the commitment? To design and implement a tool for monitoring and evaluating the
National Plan for Access to Justice and Legal Protection of Persons
with Disabilities.

possibility to participate and influence decisions and changes
promoted by the implementation of the plan.

There is no information in digital format for monitoring compliance with
the Plan for Organized Civil Society.

This commitment works towards accountability, since its objective is to
report on the progress made in the fulfillment of the Plan and to make
visible the results of the Plan. Moreover, the participation of organized
civil society is fundamental in the development of the plan and in its
implementation and follow-up.
Additional information
The National Plan has been conceived taking a public policy approach, as a process, that is,
as the result of the interaction and coordination of different political actors from the three
branches of government and Civil Society in general, who have worked since the design
stage in a spirit of consensus and who will actively participate in its implementation, follow-up,
evaluation and monitoring. That is why strategic guideline number 5 of the plan is follow-up,
evaluation and public dissemination of the plan.
It was created with the objective of eliminating the barriers and obstacles that impede the
access of persons with disabilities to recognition as subjects of law and to the protection of
these rights. In this sense, it aims to break down judicial, physical, institutional, cultural and
social barriers that prevent access to justice and, especially, to address the issue of disability
using the social model set out in the International Convention on the Rights of Persons with
Disabilities, shifting from a model of substitution of persons with disabilities to a model of
support.
Currently, there are three working groups organized under the following themes: 1 –
Regulatory Adaptation Group, 2 – Disability, Tertiary and University Education, 3 – Disability
and Deprivation of Liberty. Within the framework of these working groups, a survey was
carried out to gauge tertiary level curricular offerings on the subject of disability. At present, a
survey on universal accessibility is being carried out at the State and tertiary education levels.
Together with the National Directorate of Monitoring and Evaluation of the Ministry of Social
Development, a questionnaire is being prepared to assess compliance with the rest of the
actions envisaged in the Plan.

29. Seguimiento y evaluación permanente del Plan Nacional de acceso a la justicia y protección jurídica de las personas en situación de discapacidad (2015/2020)

Contexto y objetivos
En 2015 el Gobierno uruguayo aprobó el Plan Nacional de Acceso a la Justicia y Protección Jurídica de las Personas en Situación de Discapacidad 2015-2020 [125] que tiene como objetivo eliminar barreras y obstáculos que impiden el acceso y el reconocimiento de las personas en situación de discapacidad en su condición de sujetos de derechos. Esta iniciativa da cumplimiento a la Convención Internacional sobre los Derechos de las Personas con Discapacidad, aprobada en 2006 y a los compromisos nacionales e internacionales asumidos por el Estado uruguayo.
El plan se desarrolló a través de un trabajo interinstitucional de los poderes Ejecutivo, Legislativo y Judicial junto a la sociedad civil organizada.
El plan propone cinco líneas estratégicas. La línea estratégica número 5 se refiere al seguimiento, evaluación y difusión pública del plan. Este compromiso se propone aportar a esta línea estratégica desarrollando una herramienta informática que permita a las personas y las organizaciones de la sociedad civil vinculadas a la temática poder hacer un seguimiento de los compromisos asumidos por el Gobierno y darles la posibilidad de participar e incidir, lo que no era posible hasta ahora.
Con el objetivo de poder evaluar cabalmente este compromiso, las investigadoras enviaron una consulta a las 10 organizaciones de la sociedad civil que participaron en la elaboración del Plan Nacional, pero solo se obtuvieron dos respuestas. Las dos organizaciones que respondieron [126] dan cuenta de la participación en la elaboración del plan, pero manifestaron no haber recibido invitación a participar del seguimiento.
La persona referente del Observatorio Uruguayo de los Derechos para las Personas con Discapacidad [127] manifestó que muchos de los acuerdos establecidos en el marco del plan no se han cumplido. Asimismo expresó las expectativas para el avance en temas que no han sido tratados con las organizaciones sociales y a los que no se les ha dado respuesta. El Observatorio ha seguido aportando y exponiendo sus prioridades, pero a la hora de concretar, ven que muchos de los temas están ausentes. Considera que la herramienta digital de seguimiento es de suma importancia, pero el plan de gobierno es mucho más importante, donde hay pendientes reglamentaciones, leyes y acuerdos.
Las acciones propuestas en el compromiso son lo suficientemente específicas como para que se puedan verificar objetivamente. De ser implementando completamente, este compromiso tendrá un impacto moderado en la apertura del Gobierno generando un mejor acceso a la información, no así en la rendición de cuentas como se establece en el texto del compromiso. Esto porque que no prevé mecanismos de retroalimentación o canalizaciones de consultas con los interesados directos, como lo ha confirmado la sociedad civil consultada, sino que la herramienta se limitará a publicar la información.
Siguientes pasos
Tomando en cuenta que a partir de este compromiso la herramienta quedará implementada y en funcionamiento, las investigadoras del IRM consideran que no sería necesario incluir este compromiso en un próximo plan. Sin embargo, sería imprescindible durante la implementación pensar estrategias tendientes a fomentar el uso de la herramienta con proyectos que apunten a fortalecer la auditoría social y el monitoreo, a través de un trabajo conjunto con la sociedad civil que participó en la elaboración del plan.
