Quebec officially joined the Open Government Partnership (OGP) on October 22, 2020. The Gouvernement du Québec then set up a forum in 2021 to ensure the support of non-governmental stakeholders in the development of the 2021-2023 action plan. Within the government, the Secrétariat du Conseil du trésor (SCT) was responsible for setting up this forum called the “Open Government Committee”. This Committee is composed of eight (8) representatives of civil society and representatives of three (3) public organizations, including the Secrétariat du Conseil du trésor which supervises the work. The Committee’s mandate is to advise the Gouvernement du Québec on the development, implementation and evaluation of open government action plans

1.2 Is the forum multi-stakeholder?

The “Open Government Committee” is composed of eight (8) members of civil society and representatives of three (3) public agencies. This Committee therefore provides a space for co-creation that includes government and non-government representatives. Although the agenda and the major orientations are set by the Gouvernement du Québec (Secrétariat du Conseil du trésor), the members of the Committee emphasize that their participation is free and that their suggestions are listened to during the meetings.

The eight non-governmental members are:

1.3 Does the forum hold at least one meeting with civil society and non-governmental stakeholders during the co-creation of the action plan?

The “Open Government Committee” first met five (5) times between April and May 2021, at the initiative of the Secrétariat du Conseil du trésor, in order to offer suggestions and comments to the Gouvernement du Québec on the development of the action plan. The Committee then met at the end of 2021 to review the final action plan and discuss the implementation of the plan. Participants reported that they attended the majority of the Open Government Committee meetings. This indicates a high level of involvement by the members of this Committee and a constant mobilization during the meetings. As of the writing of this report (February 2022), six meetings have been held:

1.4 Has the action plan been endorsed by the stakeholders of the forum or steering committee/group?

The commitments that structure the action plan were presented to the members of the “Open Government Committee” at one of its meetings (May 27, 2021). Consultation of the working documents from the May 27, 2021 meeting shows that the Committee members were aware of all the commitments that would eventually be included in the action plan (including draft milestones that would structure the commitments in the action plan). At the same time, interviews with committee members indicate that not everyone was aware of formally endorsing or approving the various commitments that would be included in the action plan. Several committee members explained that they became aware of the action plan at the end of 2021. This can be explained by a long period between the initial work of the Committee (April and May 2021) and the time of the interviews with stakeholders and the presentation of the action plan to the Committee (November and December 2021). While Committee members explain that they were able to contribute freely to the discussions at the various meetings, formal approval of the final action plan commitments as such by Committee members is not evident to all.

2.1 Does the government maintain a Local OGP website or webpage on a government website where information on the OGP Local process (co-creation and implementation) is proactively published?

This page provides access to information on the implementation of open government, open data, public consultations, and the transparency and performance of the Gouvernement du Québec. This page is hosted on the Gouvernement du Québec’s portal, https://www.quebec.ca/. This portal centralizes the government’s digital information and services, making it easier for citizens to read and access information. In addition, a specific page about the Open Government Action Plan 2021-2023 is also available. This page includes information on the cycle of open government action plans in Quebec and the commitments of the last action plan itself. You can also find details on implementation, sharing of results and public input, and on Quebec’s open government achievements.

2.2 Did the government provide information to stakeholders in advance to facilitate informed and prepared participation in the co-creation process?

Interviews with members of the “Open Government Committee” revealed that the Gouvernement du Québec (through SCT) shared background documents in advance of the first meetings. The agenda and a summary of the previous meeting’s discussions were sent to all participants before each meeting. Members noted that SCT did a great deal of preparation and synthesis work before and after the meetings. The meetings often began with a briefing period to familiarize Committee members with the topics under discussion. However, some non-governmental stakeholders would have liked to receive information in advance of the meetings, while others indicated that busy agendas would not have allowed for more preparation work before the meetings.

2.3 Did the government ensure that any interested member of the public could make inputs into the action plan and observe or have access to decision-making documentation?

The establishment of the forum – called the “Open Government Committee” – by the Gouvernement du Québec (SCT) allowed representatives of eight civil society organizations to express opinions, comments and suggestions on the themes defined by the government. Committee members report that discussions were free and everyone had the opportunity to express their views. The Committee can therefore be described as an arena for consultation with civil society. With respect to public participation in the broadest sense (citizens), the authors of this inception assessment report did not observe any specific channels of participation during the process of developing the 2021-2023 action plan.

2.4 Did the government proactively report back or provide written feedback to stakeholders on how their contributions were considered during the creation of the action plan?

In interviews with members of the Open Government Committee, it was not clear to many of them how their contributions ultimately influenced the drafting of the action plan. Committee members saw their role more as that of experts who inform the government and respond to its requests and proposals. It should be noted that at each meeting, a summary of the previous meeting’s discussions was sent to all participants (see section 2.2). Non-governmental stakeholders were thus able to see what had been noted by the government during the discussions. However, it was apparently not possible for members to determine how the discussion points were then concretely translated into the action plan.

2.5 Was there an iterative dialogue and shared ownership between government and non-governmental stakeholders during the decision making process, including setting the agenda?

The identification of priorities, the development of the exchange agenda, and the development of the actual commitments were the work of the government (through the SCT). However, interviews with members of the “Open Government Committee” indicate that discussions around the government’s proposals were open and unconstrained. As a result of the observations noted above, members saw their role as informing the government on topics that had been identified in advance. Some members expressed the wish to have more weight in the definition of the major orientations of the future action plan, while others emphasized their comfort in this advisory role (notably because of the work and calendar constraints). In conclusion, even if the dialogue set up during the process of developing the 2021-2023 action plan cannot be described as fully iterative, it still took into account the contributions of the Committee involving the Gouvernement du Québec and the non-governmental stakeholders.

2.6 Would you consider the forum to be inclusive and diverse?

In its call for nominations for the “Open Government Committee”, the government mentioned a clause on inclusion and diversity (“equal access to the committee”). However, it was not possible to determine how this criterion was taken into account in the selection of Committee members. It appears that the criterion of expertise of the candidates prevailed over the criterion of diversity. A partial analysis of the composition of the “Open Government Committee” against criteria of equity, diversity and inclusion (visible only) suggests that the Committee is inclusive and diverse only to some extent. For example, women and visible minorities appear to be severely under-represented in relation to the Quebec population. It should be noted, however, that the authors did not ask Committee participants about how they defined themselves in relation to various criteria. The observations made here should therefore be considered with caution.

1. Commitment :

Democratize open data

1.1 Is the commitment verifiable?

Commitment 1 includes five (5) clearly titled milestones, which aim to achieve defined objectives: “Create a pedagogical section on the Quebec Data portal”, “Improve visualization on the Quebec Data portal”, “Release five new reference datasets”, “Conduct a pilot prioritization project with the population for an open data theme” and “Publish a research project on potential open data ecosystems and interoperability challenges”. Some of the headings are quite general, but concise explanations clarify the purpose of each milestone. The various milestones have a deadline and are under the responsibility of a government agency (the SCT for four of them, and Bibliothèque et Archives nationales du Québec for another). These elements should make it possible to verify the achievement of the objectives set.

This document contains six orientations including, in particular, the principle of “open data by default”. It should also be noted that the Gouvernement du Québec has set up the “Données Québec” portal, a platform that offers 1,213 public data sets to date (February 2022). Commitment 1 therefore continues the government’s previous actions in the area of open data and aims, in particular, to develop actions related to the “Quebec Data” portal (Portail Données Québec -see the milestones mentioned in section 3.1.1).

2. Commitment :

Promote immediate and open access to scientific articles funded by the Fonds de recherche du Québec.

These milestones have a deadline (December 31, 2022) and are placed under the responsibility of a public organization, the Fonds de recherche du Québec (FRQ). These elements should make it possible to verify the achievement of the objectives set.

3. Commitment :

Improve digital public consultations.

These titles are general, but concise explanations specify the content of each milestone. These different milestones are accompanied by deadlines and are placed under the responsibility of a government agency, the Secrétariat du Conseil du trésor, which will collaborate with the Ministère du Conseil exécutif (MCE). The elements presented should make it possible to verify the achievement of the objectives set by each milestone.

Commitment 3 is in line with participation practices already established in Quebec. For example, in 2017, the Gouvernement du Québec adopted a “Cadre de référence gouvernemental sur la participation publique”. This framework sets out seven guiding principles for public organizations wishing to hold consultations. Also, the Gouvernement du Québec has put the “Consultation Québec” platform online. This platform is intended to bring together all of the government’s public consultations in order to make participatory initiatives more visible to Quebec citizens. Commitment 3 therefore aims to pursue and develop participation initiatives of the Gouvernement du Québec.

Additional information about, for example, the “continuous improvement approaches” that should make it possible to involve citizens would also improve the follow-up and concrete implementation of commitment 3.

4. Commitment :

Propose a simplified process for the micro procurement of information resources (IR)

4.1 Is the commitment verifiable?

Commitment 4 includes two (2) clearly titled milestones, which aim to achieve defined objectives: “Implement the “Interdeveloper Exchange” platform” (Plateforme Échanges entre concepteurs) and “Make regulatory changes to simplify the public tendering process”. These milestones have a common deadline (August 31, 2022) and are under the responsibility of the Secrétariat du Conseil du trésor (with the collaboration of Infrastructures technologiques Québec for the first milestone). The elements presented in the action plan should make it possible to verify the achievement of the set objectives.

Given the good practices disseminated and promoted by the OMP, possible points of improvement include the addition of additional details in the action plan regarding commitment 4, such as the contact information of the persons responsible (within the Secrétariat du Conseil du trésor and Infrastructures technologiques Québec) or the resources, personnel and budgets allocated to this commitment in particular.

5. Commitment :

Equip government employees in the use of open source software.

5.1 Is the commitment verifiable?

The information outlined in the action plan provides elements that could help verify, in part, the achievement of these broadly defined objectives.

Commitment 5 is in line with certain good practices regarding interoperability and the use of open source software already promoted within the Quebec public administration. On the one hand, the Centre québécois d’excellence numérique has defined “good government digital practices” that include an invitation to “prioritize reuse and interoperability” (good practice #15). In addition, the Secrétariat du Conseil du trésor also promotes the use of open source software for certain services. Commitment 5 therefore aims to pursue, disseminate and develop these good practices in terms of open source software.

The milestones that make up Commitment 5 do not seem, at this stage, to be intended to generate binding or institutionalized changes within the administration with respect to the use of free software. Nevertheless, these proposals have the potential to continue the diffusion of a “culture of free software” within the Quebec government, which could eventually lead to important change

5.5 Are there any recommended changes to the design of the commitment to help improve its implementation?

Considering the good practices disseminated and promoted by the OGP, the possible points of improvement are the addition of details in the action plan regarding commitment 5, such as the contact information of the persons in charge (within the Secrétariat du Conseil du Trésor) or the resources, personnel and budgets allocated to the accompaniment and sharing of free software practices.
