Section 3.
Initial evaluation
of commitments

1. Commitment :

Making transparency proactive in Nuevo León

1.1 Is the commitment verifiable?

Yes

Provide a brief explanation of your answer:

The design of the instrument, in this case, a Proactive Transparency Guide, will include in the first period a public consultation and reviews to corroborate public information needs, as well as socialization mechanisms that allow improvements to the instrument. In the medium term, it will facilitate the sharing of information through the creation of didactic content. In the long term, it is expected to monitor its implementation as a result of the voluntary manifestation of the regulated entities.

Provide evidence for your answer:

1.2 Does the commitment language/activities clearly justify relevance to OGP values?

Yes

Provide a brief explanation of your answer:

The guide directly addresses the importance of transparency for access to information and, therefore, accountability to citizens. Similarly, according to the milestones raised, there will be citizen participation in the development of these, so it is intended to generate a collaborative instrument that affects the public information needs of citizens while facilitating the understanding of its instrumentalization so that it is carried out voluntarily.

Provide evidence for your answer:

1.3 Please select one option that best describes the commitment:

a continuation of ongoing practice in line with existing legislation, policies or requirements.

Provide a brief explanation of your answer:

Currently, the Law of Transparency and Access to Public Information of the State of Nuevo León contemplates that obligated subjects must promote and implement proactive transparency policies seeking their accessibility. Similarly, at the national level, guidelines are established to determine the catalogs and publication of information of public interest; and for the issuance and evaluation of proactive transparency policies, which should set the standard for the characteristics and criteria applicable to proactive transparency.

Provide evidence for your answer:

1.4 Please select one option that best describes the commitment:

is a positive change to a process, practice or policy but will not generate a binding or institutionalized change across government or specific institution(s).

Provide a brief explanation of your answer:

Pursuant to what is described in the roadmap, the instrument of the”Guideof proactive transparency”, joins the actions to promote the implementation of proactive transparency that the same law provides. However, by the very nature of “proactive” guidelines and in accordance with what is established by current regulations, does not generate a commitment to its execution beyond disclosure and socialization to the regulated entities so that they can implement its use.

Provide evidence for your answer:

1.5 Are there any recommended changes to the design of the commitment to help improve its implementation?

Yes, certainly, it is a product with positive value in terms of proactive transparency. However and the added value that this instrument can provide requires simple language, channeling accessibility mechanisms, and, above all, maintaining an interdisciplinary perspective that allows easy understanding to carry out its execution and thereby encourage more obligated subjects to use the instrument.

2. Commitment :

Open Government Committee to reinforce data of the Attention to Victims of Familiar Violence and Genre of Monterrey Unit regarding violence against women

2.1 Is the commitment verifiable?

Yes

Provide a brief explanation of your answer:

Based on the information contained in the Roadmap of this commitment, it is possible to clearly establish the objective that pursues, being this the installation of a coordination space called the Open Government Committee between government actors and civil society organizations, for the management, analysis, and dissemination of information that allows making better decisions in actions aimed at the elimination of gender-based violence in the municipality of Monterrey, Nuevo León.

Provide evidence for your answer:

2.2 Does the commitment language/activities clearly justify relevance to OGP values?

Yes

Provide a brief explanation of your answer:

It might be worth considering words that anyone can recognize and associate with respect to the expected products and results.
As an additional element of the clarity of the commitment, an alignment is presented to the Sustainable Development Goals and Goals of the 2030 Agenda, unlike the two previous commitments of the municipality of San Pedro Garza García.
In relation to the review of the information contained in the Roadmap, it is relevant to highlight that there are some components that are still pending completion, such as the Strategic Vision. To advance in this aspect, it is suggested to establish certain conditions that focus on the expected results of the Committee, so that actions can be designed aimed at positively impacting the indicators related to gender violence.
Additionally, the importance of having access to the most recent versions of the documents available in the electronic portal assigned to download and consult information related to the Local Action Plan, especially in matters of violence, is underlined. This is due to the fact that there are some objectives pending to be drafted, such as the short-term objective that does not contain further information on the review date, and its completion date is scheduled for the month of July of the current year.
Although elements of citizen participation have been identified in some of the actions implemented during the operation of the Committee, it is essential to take into account the regulatory framework and the specific actions that correspond to this figure. In other words, it is necessary to determine if its structure requires regulations or legislation for its proper functioning and avoid duplication of functions of other state agencies

Provide evidence for your answer:

2.3 Please select one option that best describes the commitment:

a new regulation, policy, practice or requirement.

Provide a brief explanation of your answer:

The configuration of this type of space represents an opportunity to close gaps and above all to protect and safeguard the rights of people in inequality.
It is essential to highlight that the constant participation of groups, collectives, and civil society actors who are experts in the matter is essential to guarantee the correct functioning and usefulness of the installation of the Open Government Committee. In addition, in terms of Accountability, the participation of civil society should be considered to accompany the actions derived from the Open Government Committee. This will make it possible to monitor the mechanisms available to victims of complaints and the accessibility of said mechanisms.

Provide evidence for your answer:

2.4 Please select one option that best describes the commitment:

is a positive change to a process, practice or policy but will not generate a binding or institutionalized change across government or specific institution(s).

Provide a brief explanation of your answer:

The commitment activities have the potential to modify practices or policies to influence the actions of different areas responsible for guaranteeing the safety of women and reducing gender-based violence.
It is important to establish that the commitment establishes a milestone, which is to institutionalize the Committee, where it is recommended to establish the use and exploitation of data for government agencies through its regulations.
However, it is intended for a long-term objective which is the construction and installation of an Observatory for statistical analysis, for this reason, it is important to consider previous activities that allow citizens to know -in open data- information related to the conditions of violence suffered by vulnerable groups and women in the municipality of Monterrey.

Provide evidence for your answer:

2.5 Are there any recommended changes to the design of the commitment to help improve its implementation?

No.

3. Commitment :

Creation of spatial data infrastructure for urban development in Monterrey, that guarantees the right to the city, under the open government principles

3.1 Is the commitment verifiable?

Yes

Provide a brief explanation of your answer:

From the reading of the objective and activities, visibility can be inferred in the use of data associated with urban development in the Municipality of Monterrey in the state of Nuevo León. However, it will be important to use clearer and simpler language in how a link will be generated between the activities of collection, publication, visualization, and the use of information to improve the urban development of the aforementioned municipality.
As part of this unknown, the commitment itself states the following: “Although data transparency does not completely solve the public problem, having more information in this regard contributes to the creation of public policies and social changes for a greater resolution of the problem.”
While it is true that the information that is collected and published in open data is relevant, so is the importance of having a space for collaboration that makes it possible to guarantee that urban development is inclusive and promotes accountability environments to avoid associated risks to the decrease in the quality of life of the inhabitants or transients of the territory.

Provide evidence for your answer:

3.2 Does the commitment language/activities clearly justify relevance to OGP values?

Unclear

Provide a brief explanation of your answer:

As part of the activities, it is observed that, in principle, the commitment will seek transparency in the data that two government entities have: SEDUSO and IMPLANC. In this sense, it is considered pertinent to assign activities aimed at building a joint diagnosis with civil society organizations, to determine that the information effectively represents clear access to the data used for the urban development of the municipality. In this way, more spaces for participation can be enabled that contribute to positioning civil society at the center of decision-making on this matter.
Notwithstanding the foregoing, it is important to establish the target population more clearly. With this delimitation, it will be possible to generate some other complementary activities that guarantee that access to the data will serve the dependencies to jointly build urban development plans that have a positive impact on the residents, inhabitants, or people in transit in the selected territory.

Provide evidence for your answer:

3.3 Please select one option that best describes the commitment:

a continuation of the ongoing practice in line with existing legislation, policies, or requirements.

Provide a brief explanation of your answer:

Although the activities of the commitment do not represent a change or integral transformation, the truth is that the opening of the data could bring about a potential reconfiguration of decision-making in the field of urban development, mobility, and public space. In this sense, it is possible to foresee an institutionalized change in the organizations responsible for planning and urban development in the short and medium term. It is important to say that greater participation of civil society organizations is deemed necessary to permanently monitor the technical evaluation of the data that will be collected and published, in order to generate parameters of accessibility, use, exploitation, etc. of open data and the other characteristics of this modality.
On the other hand, it is equally relevant not to delegate the relevance in the participation of specialized organizations to establish channels of communication between government agencies and citizens and that, the requests of the citizens, find an echo in the public servants assigned for their timely response and attention.

Provide evidence for your answer:

3.4 Please select one option that best describes the commitment:

is a positive change to a process, practice, or policy but will not generate a binding or institutionalized change across government or specific institution(s).

Provide a brief explanation of your answer:

It is estimated that the commitment will not generate institutionalized changes in the short term. The effort for the composition of a spatial data infrastructure in terms of urban development implies specific actions that can bring benefits to land use planning in the long term. However, a disconnection between the short and long-term objectives is observed where the citizen participation component is not entirely clear, the above is part of the initial diagnosis, which establishes the challenges of the new urban planning according to the characteristics of the population.
For its part, the commitment has the potential to ensure that urban development respects people’s rights and therefore it is necessary to make transparent -as the commitment indicates- construction permits, risk conditions in areas of urban growth, and improvement needs in public spaces. However, it is necessary that, in the future, the commitment consider more mechanisms for citizen participation so that society can place itself at the center of public decision-making and rights are not violated.

Provide evidence for your answer:

3.5 Are there any recommended changes to the design of the commitment to help improve its implementation?

No. Although profound changes in the configuration of the commitment are not estimated, it would be worth exploring the possibility of integrating activities aimed at promoting greater citizen participation in the development of urban plans.

4. Commitment :

Open Government Strategy on Active and Inclusive Metropolitan Mobility – Green Corridors

4.1 Is the commitment verifiable?

Yes

Provide a brief explanation of your answer:

The established Roadmap indicates that the creation of a report on green corridors will allow greater transparency in this matter by detecting the lack of information.

4.2 Does the commitment language/activities clearly justify relevance to OGP values?

Yes

Provide a brief explanation of your answer:

In accordance with the established Roadmap, there is no clear information regarding the issue of green corridors. The creation of this report will allow transparency on the matter. In turn, citizen collaboration through consultations, will allow the creation of an innovative instrument on the subject. Therefore, it is intended to impact the values of citizen participation, transparency, and innovation while having an impact on accountability in terms of mobility.

Provide evidence for your answer:

4.3 Please select one option that best describes the commitment:

a continuation of ongoing practice in line with existing legislation, policies or requirements.

Provide a brief explanation of your answer:

It is to be recognized the mobility problem in the Monterrey Metropolitan Area. The Así Vamos 2021 Survey reveals three major mobility challenges for Nuevo León, particularly for the Metropolitan Area: 1) reverse the drop in public transport users, 2) improve efficiency in transfer times, especially for users of trucks, and 3) promote the adequate infrastructure conditions for greater use of the bicycle. Therefore, in addition to being a priority issue for public consultation prior to the design of the LAP, it affects a public problem that demands priority attention from citizens.

4.4 Please select one option that best describes the commitment:

is a positive change to a process, practice or policy but will not generate a binding or institutionalized change across government or specific institution(s).

Provide a brief explanation of your answer:

The document in question presents a diagnosis of the problem that has already been pointed out by other sectors and citizen practice. Although the development of the Roadmap, at the time of consultation, they meet with dialogs open, it is recommended to generate active participation and materialize the milestones more clearly and easily. Highlighting that the contributions of the commitment will be valuable and will allow us to make informed decisions in the future.

Provide evidence for your answer:

4.5 Are there any recommended changes to the design of the commitment to help improve its implementation?

No. Although the commitment is clear and defined, since this is a problem that affects multiple actors and levels of government, it would be worthwhile to involve more actors in order to have a metropolitan panorama that allows knowing the implications of mobility floating.
